Eviction & Unlawful Detainer Documents

Eviction & Unlawful Detainer Documents
for Bay Area landlords

An eviction is the overall process; an unlawful detainer is the court action used to seek possession of property. ClearPath provides landlord-directed document preparation, not tenant responses or court representation.

We prepare documents selected by you or your attorney using the facts and instructions you supply. We do not determine whether an eviction is lawful, select a notice, calculate legal deadlines, recommend grounds, or advise how to respond to defenses.

California and local rental rules can affect a landlord's options. Obtain legal advice before choosing your procedure, documents, notice, requested amounts, filing date, or strategy.

Important Context

Key Considerations

Landlord-only, directed preparation

You or your attorney select the notice, forms, court, parties, grounds, dates, amounts, filing date, and strategy. ClearPath does not determine whether an eviction is lawful.

Timing and local rules vary

California eviction laws are highly complex and localized. Flawed notices can result in immediate case dismissal. Obtain legal advice before directing us.

Landlord eviction document questions

Common questions about our eviction & unlawful detainer documents services.

See all FAQs →

Is eviction the same as unlawful detainer?

Eviction describes the broader process. Unlawful detainer is the court action used to seek possession of property. This landlord-only document service includes selected paperwork that may arise during that process.

Do you assist landlords or tenants?

This offering is for landlord-directed document preparation only. Tenant answers, tenant defenses, and representation for either side are not included.

Can ClearPath tell me which notice to use?

No. You or your attorney select the notice and its terms. ClearPath does not determine grounds, notice duration, service requirements, dates, exemptions, rent-control coverage, just cause, or recoverable amounts.

What does the $695 complaint packet include?

It covers preparation of one client-selected opening unlawful-detainer complaint packet within the written scope. Court fees, service of process, later filings, and the separate $125 filing-coordination add-on are not included.

What does the $1,495 package cover?

It covers a selected notice, complaint, default and judgment, and writ paperwork for one uncontested landlord matter proceeding through default. Contested work, court appearances, representation, and third-party costs are excluded. Standalone preparation fees are not added again for the same included work.

What if the tenant files an answer?

The package does not automatically include contested work. Consult an attorney about the response, deadlines, trial, and strategy. Any remaining administrative document work must be separately confirmed.

Can ClearPath guarantee when I will regain possession?

No. Notice periods, filing, service, tenant responses, hearings, court decisions, and sheriff scheduling affect timing and outcome. Document preparation does not guarantee acceptance, judgment, possession, or recovery of money.

Are filing and process service included?

No. Filing coordination is a separately confirmed $125 add-on. Process-server coordination is $125–$175 plus the server fee. Court, publication, provider, process-server, sheriff, certified-copy, mailing, and other third-party charges remain additional.
